DECISION & ORDER ON MOTION

Motion by respondent on an appeal from an order of the Justice Court of the Town of Tuxedo, Orange County, entered January 6, 2011, for poor person relief and the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in response thereto, it is

ORDERED that the motion is granted and ROBERT L. HERZFELD, ESQ. located at

61 BROADWAY, SUITE 1601, NEW YORK, NEW YORK 10006 is assigned pursuant to article 18-B of the County Law; and it is further,

ORDERED that the respondent's brief shall be served within 30 days of the date of this decision and order; and it is further,

ORDERED that appellant, if it be so advised, may serve and file a reply brief within 14 days of the date that the respondent's brief is due to be filed pursuant to this decision and order.
