WITHDRAWAL OF MOTION FOR ORDER TO SHOW CAUSE

Defendant-Appellant Wade Patrick Grost, by and through JONATHAN B.D. SIMON, his court appointed counsel for post conviction proceedings, withdraws his motion for an order to show cause why court reporter Susan Melton should not be held in contempt of court, stating:

1. On November 29, 2022, counsel was notified that within 21 days the matter was eligible for involuntary dismissal due to Reporter Melton's failure to file transcripts. On December 3, 2022 Counsel moved for an order to show cause.

2. The transcripts have now been filed and the matter in now apparently moot.

WHEREFORE, Appellant withdraw's his show cause motion.

CERTIFICATION OF SERVICE

Pursuant to MCR 2.104(A)(2)(d)JONATHAN B.D. SIMON certifies that on the 17th day of December, 2022, he served a copy of Defendant-Appellant's WITHDRAWAL OF MOTION FOR ORDER TO SHOW CAUSE upon the following:

Ms. Susan Melton 313 W. Kalamazoo, 3rd Floor Lansing, Michigan 48933 by placing the same in envelopes plainly addressed as above with appropriate postage affixed thereon and depositing the same in a United States postal receptacle.
