Present — Cunningham, Taylor, Dowling, Harris and McCurn, JJ.


Judgment of conviction modified on the facts as a matter of discretion by reducing the sentence of imprisonment of ten to twenty years to imprisonment from five to ten years and as modified affirmed. (See People v. Spagnolia, 260 App. Div. 551; Penal Law, §§ 1308, 1941.) Order affirmed. All concur. (The judgment convicts defendant of the crime of criminally receiving stolen property. The order denies defendant's motion to amend and correct the stenographer's record.)
