People v. Grillo

Appellate Division of the Supreme Court of New York, Second Department
Dec 18, 1961
15 A.D.2d 536 (N.Y. App. Div. 1961)

Opinion

December 18, 1961

Appeal by defendant from an order of the County Court, Richmond County, dated April 26, 1961, denying, without a hearing, his coram nobis application to vacate so much of a judgment of said court, rendered June 16, 1960, upon his plea of guilty, convicting him of attempted forgery in the third degree, as sentenced him, as a second felony offender, to serve a term of two and one-half to five years. Defendant contends that he is entitled to be resentenced to a term which will not only be concurrent with another sentence imposed upon him in 1959 by the County Court, Kings County, upon his conviction of another crime, but which will also commence nunc pro tunc as of October, 1959, the date he commenced serving such other sentence. Order affirmed. No opinion. Nolan, P.J., Ughetta, Christ, Pette and Brennan, JJ., concur.
