THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. DAVON GRIFFIN, DEFENDANT-APPELLANT.


PRESENT: , P.J., SMITH, CENTRA, FAHEY, AND CARNI, JJ.

Appellant having moved for an extension of time to perfect the appeal taken from the judgment of Onondaga County Court, rendered August 31, 2012, and for other relief,

Now, upon reading and filing the affirmation of Linda M. Campbell, Esq. dated March 17, 2014, the notice of motion with proof of service thereof, the affirmation of Misha A. Coulson, Esq. dated March 26, 2014, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks an extension of time to perfect is granted on the condition that appellant perfect the appeal on or before July 14, 2014, and in the event of failure to so perfect, the appeal is hereby dismissed without further order, and

It is further ORDERED that the motion insofar as it seeks disclosure of certain documentation is denied without prejudice to the parties addressing the issue in their briefs.
