MOTION DECISION

Defendant having moved for leave to prosecute, as a poor person, the appeal purportedly taken to this Court from a judgment of the Supreme Court, Bronx County, rendered on or about September 15, 2023, for assignment of counsel, and for related relief, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is Ordered that, sua sponte, the moving papers are deemed a timely filed notice of appeal, and

It is further Ordered that, to the extent that the motion seeks poor person relief, such relief is denied, with leave to renew upon defendant's submission of a notarized affidavit, in compliance with CPLR 1101(a) and 22 NYCRR 12504(d)(1) and (4), setting forth the terms of defendant's retainer agreement with trial counsel, as well as the amount and sources of funds for retained trial counsel's fee, and an explanation as to why similar funds are not available to prosecute this appeal.
