People v. Green

Appellate Division of the Supreme Court of New York, First Department
Mar 8, 1994
202 A.D.2d 224 (N.Y. App. Div. 1994)

Opinion

March 8, 1994

Appeal from the Supreme Court, New York County (Budd Goodman, J.).

We find that defendant's bargained for sentence was not excessive, and thus, there is no need for a remand to reconstruct the plea proceeding to determine whether defendant waived his right to appeal the sentence.

Concur — Murphy, P.J., Kupferman, Asch, Williams and Tom, JJ.
