PEOPLE OF THE STATE OF MICHIGAN, Plaintiff-Appellee, v. DAMARIUS MONTRAIL GREEN, Defendant-Appellant.
Genesee CC: 17-041898-FC
Elizabeth T. Clement, Chief Justice Brian K. Zahra, David F. Viviano, Richard H. Bernstein, Megan K. Cavanagh, Elizabeth M. Welch, Kyra H. Bolden, Justices
ORDER
On order of the Court, the application for leave to appeal the March 14, 2024 judgment of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.
Welch, J. (dissenting).
For the reasons stated in my dissenting statement in People v Purdle, ___Mich ___ (2024) (Docket No. 166967) (Welch, J., dissenting), I would have moved forward with oral arguments in Purdle to consider the defendant's arguments against the legality of "de facto" life sentences. Accordingly, I would have held this case in abeyance pending resolution of Purdle.
