DECISION & ORDER ON MOTION

Motion by Mitchell Dranow, Esq., retained counsel for the respondent, for leave to withdraw as counsel and to assign another attorney to respond to an appeal from an order of the Supreme Court, Nassau County, entered May 4, 2010, and to enlarge the time to serve and file a respondent's brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted, and Mitchell Dranow, Esq., is directed to turn over all papers in the action to new counsel herein assigned; and it is further,

ORDERED that pursuant to County Law § 722 the following named attorney is assigned as counsel to respond to the appeal:

Leon Tracy, Esq.
and it is further,

ORDERED that the respondent's time to serve and file a brief on the appeal is enlarged until October 3, 2012, and the respondent's brief shall be served and filed on or before that dated; and it is further,

ORDERED that the motion is otherwise denied.
