Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Jefferson County Court, rendered May 26, 2010,
Now, upon reading and filing the affidavit of Shawn Granger sworn to July 29, 2011, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that, pursuant to CPL 460.10(6), the notice of appeal filed on June 23, 2010 under indictment number 09-265-09 is deemed a valid notice of appeal, under indictment number 10-781-09, and
It is further ORDERED that Kathleen P. Reardon, Esq. is hereby assigned to represent defendant on appeal, and the appeal may be perfected pursuant to 22 NYCRR 1000.3 (1), and
It is further ORDERED that the Clerk of the County of Jefferson is directed to provide Kathleen P. Reardon, Esq. with all papers and transcripts of stenographic or audiotaped minutes, if any, of the proceedings upon which the appeal is based.
