Appeal from a judgment of the District Court of Suffolk County, First District (Gaetan B. Lozito, J.), rendered September 24, 2008. The judgment convicted defendant, upon his plea of guilty, of assault in the third degree.

ORDERED that the judgment of conviction is affirmed.

PRESENT: MOLIA, J.P., TANENBAUM and LaCAVA, JJ.


We have reviewed the record and agree with defendant's assigned counsel that there are no non-frivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Sanchez, 68 AD3d 1140; People v Paige, 54 AD2d 631; cf. People v Gonzalez, 47 NY2d 606).
