Opinion
November 30, 1942.
Appeal from Court of Special Sessions of the City of New York.
Judgment reversed on the law, information dismissed and fine remitted. The requirement that a price list be conspicuously posted, as set forth in section 169-f Gen. Bus. of the General Business Law, is imposed solely on the licensee. There was no proof adduced by the People that this defendant was a licensee, but to the contrary, it was undisputed that he was an employee of a licensee. Lazansky, P.J., Hagarty, Carswell, Adel and Taylor, JJ., concur.
