Appellant having moved for an extension of time to perfect the appeal taken from the judgment of Chautauqua County Court, rendered August 30, 2010,

Now, upon reading and filing the affidavit of Bradley E. Keem, Esq. sworn to February 6, 2012, the notice of motion with proof of service thereof, the affidavit of Laurie M. Beckerink, Esq. sworn to February 14, 2012, and the statement of John A. Cirando, Esq. dated February 17, 2012, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted on the condition that appellant perfect the appeal on or before May 29, 2012, and in the event of failure to so perfect, the appeal is hereby dismissed without further order.
