DECISION & ORDER ON MOTION

Appeal by Kahlil Gonzalez from an order of the County Court, Westchester County, dated December 6, 2012. By order to show cause dated April 2, 2013, the appellant was directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the order dated December 6, 2012, was not appealable either by right or by permission.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed (see CPL 450.10; 450.15).
