Judgment of a city magistrate, holding a court of Special Sessions of the City of New York, Borough of Brooklyn, convicting defendant of a violation of subdivision 2 of section 65 Alco. Bev. Cont. of the Alcoholic Beverage Control Law (selling alcoholic beverage to intoxicated person), reversed on the law, the information dismissed, and the fine remitted. Defendant's guilt was not established beyond a reasonable doubt. Hagarty, Acting P.J., Carswell, Johnston, Adel and Sneed, JJ., concur.
