People v. Golden

Appellate Division of the Supreme Court of New York, First Department
Dec 11, 2003
2 A.D.3d 216 (N.Y. App. Div. 2003)

Opinion

2437.

December 11, 2003.

Judgment, Supreme Court, New York County (William Leibovitz, J.), rendered June 4, 2001, convicting defendant, upon his plea of guilty, of criminal possession of a controlled substance in the second degree, and sentencing him, as a second felony offender, to a term of 7 years to life, unanimously affirmed.

Madeleine Guilmain, for Respondent.

Lyssa M. Sampson, for Defendant-Appellant.

Before: Nardelli, J.P., Tom, Mazzarelli, Ellerin, JJ.

Defendant's arguments concerning his motion to suppress are indistinguishable from arguments this Court rejected on a codefendant's appeal ( People v. Norman, 304 A.D.2d 405), and there is no reason to reach a different result herein.

THIS CONSTITUTES THE DECISION AND ORDER OF THE SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
