PEOPLE OF MICHIGAN v. WAYNE ALAN GILES

LC No. 2007-215493-FH

ORDER

Christopher M. Murray, Chief Judge, acting under MCR 7.203(F)(1), orders:

The claim of appeal is DISMISSED for lack of jurisdiction. MCR 7.203(A)(1). The August 18, 2021, order denying the motion to set aside defendant's conviction is not a final order as defined in MCR 7.202(6)(b) and, therefore, it is not appealable of right by filing a claim of appeal. MCR 7.203(A). At this time, appellant may seek to appeal the August 18, 2021, order only by filing an application for leave to appeal or a delayed application for leave to appeal, whichever is appropriate under the circumstances.
