People v. Gilchrist, Eric

Appellate Division of the Supreme Court of New York, Second Department
Feb 5, 2001
280 A.D.2d 488 (N.Y. App. Div. 2001)

Opinion

Submitted December 6, 2000.

February 5, 2001.

Appeal by the defendant from a judgment of the County Court, Orange County (Berry, J.), rendered May 23, 2000, convicting him of assault in the second degree, upon his plea of guilty, and imposing sentence.

Ethel P. Ross, Rye, N.Y., for appellant.

Francis D. Phillips II, District Attorney, Goshen, N.Y. (David R. Huey of counsel), for respondent.

Before: LAWRENCE J. BRACKEN, ACTING P.J., FRED T. SANTUCCI, MYRIAM J. ALTMAN, ANITA R. FLORIO, JJ.

DECISION ORDER

ORDERED that the judgment is affirmed.

The defendant' s contention on appeal is unpreserved for appellate review as he did not move to withdraw his plea of guilty or vacate the judgment of conviction (see, People v. Naglieri, 262 A.D.2d 426), and we decline to reach the issue in the exercise of our interest of justice jurisdiction.
