An order of this Court having been entered on February 5, 2019 (M-5634-) granting defendant leave to prosecute, as a poor person, the appeal taken from the from a judgment of the Supreme Court, New York County, rendered on or about October 11, 2018, and assigning Christina Swarns, Esq., predecessor to Caprice R. Jenerson, Esq., Office of the Appellate Defender , as counsel to prosecute the appeal;

And the Office of the Appellate Defender having renewed their motion to be relieved as such counsel, or in the alternative to dismiss defendant's appeal, without prejudice,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that the motion is granted to the extent of deeming the appeal withdrawn and is otherwise denied. ENTERED: December 15, 2020
