PEOPLE OF THE STATE OF MICHIGAN, Plaintiff-Appellee, v. LAWRENCE FREDERICK GIBBS, Defendant-Appellant.

Order

Robert P. Young, Jr., Chief Justice Stephen J. Markman Mary Beth Kelly Brian K. Zahra Bridget M. McCormack David F. Viviano Richard H. Bernstein, Justices COA: 315652
Ingham CC: 12-000669-FC

On order of the Court, the application for leave to appeal the October 30, 2014 judgment of the Court of Appeals is considered and, pursuant to MCR 7.305(H)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for consideration of the defendant's issue regarding the Ingham Circuit Court's assessment of court costs, which the Court of Appeals did not address during its initial review of the case. In all other respects, leave to appeal is DENIED, because we are not persuaded that the remaining questions presented should be reviewed by this Court.

I, Larry S. Royster, Clerk of the Michigan Supreme Court, certify that the foregoing is a true and complete copy of the order entered at the direction of the Court.
