Appellant having moved for a writ of error coram nobis vacating the order of this Court entered September 28, 2001, affirming a judgment of Monroe County Court, rendered July 27, 1998,

Now, upon reading and filing the affidavit of Carl Gee sworn to December 19, 2014, the notice of motion with proof of service thereof, the affirmation of Stephen X. O'Brien, Esq. dated January 22, 2015, and due deliberation having been had thereon,
