Appeal from the Appellate Division of the Supreme Court in the Third Judicial Department, STEPHEN SMYK, J.

Steven T. Wax for appellant.

Patrick H. Mathews, District Attorney ( Ferris D. Leobus of counsel), for respondent.

On review of submissions pursuant to rule 500.2 (b) of the Rules of the Court of Appeals (22 N.Y.CRR 500.2 [g]), order affirmed. We agree with the determination of the Appellate Division that the warrantless arrest in defendant's motel room was justified by the presence of exigent circumstances.
