People v. Gaston

Supreme Court of Michigan
May 16, 2000
613 N.W.2d 719 (Mich. 2000)

Opinion

No. 113230 (48).

May 16, 2000.

Appeal from COA: 197556, Recorder's Ct: 95-010278.

The defendant filed a delayed application for leave to appeal, and this Court ordered the prosecutor to show cause why the defendant's conviction ought not be reversed. The prosecutor's response to this Court's July 8, 1999 order to show cause and the defendant's reply thereto have been considered.

On order of the Court, the delayed application for leave to appeal from the September 11, 1998 decision of the Court of Appeals is considered again, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

Cavanagh and Kelly, JJ., would grant leave to appeal.
