People v. Gasper

Supreme Court of Michigan.
Nov 25, 2014
497 Mich. 904 (Mich. 2014)

Opinion

Docket No. 149484. COA No. 320961.

2014-11-25

PEOPLE of the State of Michigan, Plaintiff–Appellee, v. Karl Paul GASPER, Defendant–Appellant.

Order

On order of the Court, the application for leave to appeal the April 30, 2014 order of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the question presented should be reviewed by this Court. Although the Montcalm Circuit Court erred by denying the defendant's motion under MCR 6.508(D), and the Court of Appeals erred by denying the defendant's application for leave to appeal under MCR 6.508(D), where the defendant appears to be seeking habeas corpus relief, the defendant's application for leave to appeal raises a claim that lacks merit.
