Opinion

SC: 149484

11-25-2014

PEOPLE OF THE STATE OF MICHIGAN, Plaintiff-Appellee, v. KARL PAUL GASPER, Defendant-Appellant.

Order

Robert P. Young, Jr., Chief Justice Michael F. Cavanagh Stephen J. Markman Mary Beth Kelly Brian K. Zahra Bridget M. McCormack David F. Viviano, Justices COA: 320961
Montcalm CC: 10-012905-FH

On order of the Court, the application for leave to appeal the April 30, 2014 order of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the question presented should be reviewed by this Court. Although the Montcalm Circuit Court erred by denying the defendant's motion under MCR 6.508(D), and the Court of Appeals erred by denying the defendant's application for leave to appeal under MCR 6.508(D), where the defendant appears to be seeking habeas corpus relief, the defendant's application for leave to appeal raises a claim that lacks merit.

I, Larry S. Royster, Clerk of the Michigan Supreme Court, certify that the foregoing is a true and complete copy of the order entered at the direction of the Court.
