ORDER

The application for leave to appeal is GRANTED. This order is without prejudice to the prosecutor filing a confession of error pursuant to MCR 7.211(C)(7) or defendant-appellant filing a motion for peremptory reversal pursuant to MCR 7.211(C)(4). This appeal is limited to the issues raised in the application and supporting brief. MCR 7.205(E)(4).

Jansen, J., would deny the application for leave to appeal.

O'Brien, P.J. and Cavanagh, J., would grant peremptory reversal on the application absent the unanimity requirement for such action. MCR 7.211(C)(4).
