The People of the State of New York, Respondent, v. Edward Garcia, Defendant-Appellant.


An order of this Court having been entered on November 1, 2018 (M-4410), striking the designation of assigned counsel Justine M. Luongo, Esq, The Legal Aid Society, and substituting Robert S. Dean, Esq., Center for Appellate Litigation, to prosecute defendant's appeal taken from a judgment of the Supreme Court, New York County rendered on or about July 12, 2016; and defendant-appellant having made a motion to relieve The Legal Aid Society and to assign new counsel to prosecute the aforesaid appeal, for leave to file a pro se supplemental brief, and for summary reversal and dismissal of the indictment, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,It is ordered that that branch of the motion which seeks substitution of counsel is denied, as such relief was granted in the aforementioned order (M-4410). The motion, insofar as it seeks leave to file a handwritten pro se supplemental brief, and access to record materials, is denied, with leave to renew, if defendant-appellant is so advised, after current assigned counsel files a main brief on behalf of defendant-appellant. The motion is otherwise denied.
