Petitioner having moved for an extension of time to file a notice of appeal from a an order of the Monroe County Court, dated July 13, 2013,
Now, upon reading and filing the affirmation of James Eckert, Esq. dated September 26, 2013, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted on the condition that petitioner files the notice of appeal on or before November 15, 2013, and
It is further ORDERED that the notice of appeal dated August 1, 2013 for case number 2012-20120 shall be treated as valid as to the order of Monroe County Court dated July 13, 2013 pursuant to CPLR 5520(c).
