The People did not disclose contact information for three men, one or more of whom had given the police a description, allegedly inconsistent with defendant's appearance, of a man fleeing the building where the shooting occurred. As a result, the court admitted otherwise-inadmissible hearsay as to the description (seePeople v. Gainey, 200 A.D.3d 497, 497–98, 157 N.Y.S.3d 458 [1st Dept. 2021], lv denied 37 N.Y.3d 1160, 160 N.Y.S.3d 694, 181 N.E.3d 1122 [2022] ; People v. Jackson, 264 A.D.2d 683, 695 N.Y.S.2d 357 [1st Dept. 1999], lv denied 94 N.Y.2d 881, 705 N.Y.S.2d 13, 726 N.E.2d 490 [2000] ). Furthermore, at the time of the trial two of the three men were still available as witnesses but the defense did not call them.
