The Michigan Supreme Court held that the Oakland Circuit Court erred in failing to timely appoint appellate counsel and remanded the case back to the Oakland Circuit Court to appoint counsel and file whatever appropriate postconviction motions and appeal in the Michigan Court of Appeals may be appropriate. People v. Moore, 488 Mich. 946, 790 N.W.2d 681 (Mich. 2010). Petitioner, with the benefit of appellate counsel, filed a motion to withdraw his guilty plea in the Circuit Court, which was denied.
