Summary Dispositions October 22, 1996:

In lieu of granting leave to appeal, the judgment of the Court of Appeals is reversed, and the defendant's sentence of five to thirty years is reinstated. MCR 7.302(F)(1). Because the plea bargain in this case did not contain a sentence agreement, People v Siebert, 450 Mich. 500 (1995), is inapposite. Because the parties agreed before sentencing that there were substantial and compelling reasons to depart from the presumptive mandatory minimum sentence, the trial court did not abuse its discretion in sentencing the defendant to five to thirty years pursuant to her plea of guilty to possession of over 225 but less than 650 grams of a controlled substance. MCL 333.7401(2)(a)(ii); MSA 14.15(7401)(2)(a)(ii).
