The court, on its own motion, grants reargument and upon such reargument, adheres to its original determination dated May 21, 1970 [ 34 A.D.2d 852]. Upon the appeal from the judgment, the court has reviewed and affirms the order dated August 19, 1968 which denied defendant's motion in the nature of a writ of error coram nobis. In affirming the order of August 19, 1968 the court has considered the transcript of the hearing held on July 29, 1968 and the papers related thereto. Herlihy, P.J., Reynolds, Greenblott, Cooke and Sweeney, JJ., concur.
