This is an appeal pursuant to People v. Wende (1979) 25 Cal.3d 436 (Wende). Between December 28, 2006 and December 31, 2006, the 31-year-old defendant Ryan Lee Frost had sexual intercourse with the 17-year-old female victim in a residence. Defendant entered a negotiated plea of guilty to unlawful sexual intercourse (Pen. Code, § 261.5, subd. (c)) in exchange for a stipulated midterm of two years with execution suspended and probation for five years subject to 180 to 270 days in county jail. The court imposed the stipulated term, suspended execution, and granted probation subject to certain terms and conditions including 240 days in county jail. Defendant appeals.
We appointed counsel to represent defendant on appeal. Counsel filed an opening Wende brief that sets forth the facts of the case and requests this court to review the record and determine whether there are any arguable issues on appeal. Defendant was advised by counsel of the right to file a supplemental brief within 30 days of the date of filing of the opening brief. More than 30 days elapsed, and we received no communication from defendant. Having undertaken an examination of the entire record, we find no arguable error that would result in a disposition more favorable to defendant.
DISPOSITION
The judgment is affirmed.
