Appellant counsel having moved to vacate the dismissal of the appeal taken from a judgment of the Ontario County Court, rendered September 28, 2011, and for other relief,

Now, upon reading and filing the affirmation of Eric M. Dolan, Esq. dated March 13, 2013, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and the dismissal of the appeal for failure to perfect such appeal is hereby vacated, and

It is further ORDERED that Leanne Lapp, Esq. is hereby relieved of her assignment to represent appellant on the appeal taken herein, and

It is further ORDERED that the appeal is dismissed as abandoned.
