Now, upon reading and filing the affidavit of Devon Franklin sworn to March 28, 2014, the notice of motion with proof of service thereof, the statement of Stephen X. O'Brien, Esq. dated November 17, 2014, and the statement of Andre Allen Vitale, Esq. dated November 18, 2014, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and Andre Allen Vitale, Esq. is hereby directed to file and serve the notice of appeal in accordance with CPL 460.10 on or before December 24, 2014.
