MOTION DECISION

DECISION AND ORDER ON MOTION

The People of the State of New York appeal from an order of the County Court of Clinton County (Lawliss, J.), entered April 20, 2021, which granted defendant's motion pursuant to CPL section 440.10. By order dated December 28, 2018, Noreen McCarthy, Esq., was assigned to represent defendant pursuant to County Law section 722, which included representation of defendant in connection with the CPL section 440.10 motion now under appeal.

Now, therefore, on the Court's own motion, it is

ORDERED that Noreen McCarthy, Esq., P.O. Box 756, Keene Valley, NY 12943, 518-626-1272, is assigned to represent respondent upon this appeal pursuant to County Law section 722 and the Rules of the Appellate Division, All Departments (22 NYCRR) section 1250.11 (a) (2).
