Opinion

No. 112788 (58) (67) (70).

March 21, 2000.

On June 2, 1999, we ordered the prosecutor to show cause why this case should not be remanded to the Wayne Circuit Court for an evidentiary hearing on the defendant's claims of ineffective assistance of trial counsel. The prosecutor's response to the order having been filed, and the defendant having replied, the delayed application for leave to appeal, the motion to remand, and the motion to extend time are considered. The motion to extend time is GRANTED. Pursuant to MCR 7.302(F)(1),

Summary Dispositions March 21, 2000:

In lieu of granting leave to appeal, the case is remanded to the Court of Appeals, which, while retaining jurisdiction, is to remand the case to the Wayne Circuit Court for an evidentiary hearing on defendant's claims of ineffective assistance of trial counsel. MCR 7.302 (F)(1). Court of Appeals No. 192819.
