Respondent having moved to dismiss, with prejudice, the appeal taken to this Court from a judgment of the Supreme Court, New York County, rendered on or about June 02, 2022, (Motion No. 2023-02960), the aforesaid appeal having been perfected, And defendant-appellant having cross moved for, inter alia, leave to withdraw his appellate briefs (Motion No. 2023-03134), Now, upon reading and filing the papers with respect to the motion and cross motion, and due deliberation having been had thereon, It is ordered that the respondent's motion is granted, and the appeal is dismissed (Motion No. 2023-02960); defendant-appellant's cross motion is denied (Motion No. 2023-03134).
