THE COURT:

It is ordered that the opinion filed herein on April 14, 2009, be modified as follows:

The last sentence on the first partial paragraph at the top of page seven is modified to read as follows: “The court commented that the possession of a small amount of baking soda or powder does not logically lead to a conclusion someone is armed and dangerous.”

There is no change in the judgment.
