ORDER DENYING REHEARING AND MODIFYING OPINION

THE COURT:

Appellant's petition for rehearing is denied.

The opinion, filed on April 25, 2008, is modified as follows:

On page 9, the last sentence of the second paragraph which reads, "However, a self-defense instruction would also have been inconsistent with this secondary contention that no crimes were committed that morning," is changed to read as follows:

However, a self-defense instruction would also have been inconsistent with this secondary contention, because it would imply that Flores had shot at Glasper.

There is no change in the judgment.
