People v. Fischer

Appellate Division of the Supreme Court of New York, Second Department
Jun 1, 1926
217 App. Div. 778 (N.Y. App. Div. 1926)

Opinion

June, 1926.

Judgment of conviction of the Court of Special Sessions reversed upon the law and the facts, and complaint dismissed, on the ground that the decision was against the weight of the evidence. We think the doubt raised by the evidence should have been resolved in favor of the defendant. Rich, Jaycox, Young, Kapper and Lazansky, JJ., concur.
