People v. Figueroa

Appellate Division of the Supreme Court of New York, Second Department
Jun 8, 1992
184 A.D.2d 578 (N.Y. App. Div. 1992)

Opinion

June 8, 1992

Appeal from the Supreme Court, Kings County (De Lury, J.).

Ordered that the judgment is affirmed.

The claim that the prosecutor made unfair comments during summation was not raised at the trial and is therefore unpreserved for appellate review (see, CPL 470.05; People v. Medina, 53 N.Y.2d 951).

The defendant's claim that the sentence is excessive is without merit (see, People v. Suitte, 90 A.D.2d 80). Mangano, P.J., Bracken, Balletta and O'Brien, JJ., concur.
