Opinion
B161469.
10-28-2003
Marylou Hillberg, under appointment by the Court of Appeal, for Defendant and Appellant. No appearance for Plaintiff and Respondent.
Appellant Bobby A. Fields pleaded guilty to possessing cocaine base for sale and admitted he had a prior felony conviction, making him eligible for sentencing under the "Three Strikes" law. (Health & Saf. Code, § 11351.5; Pen. Code, §§ 667, subds. (b)-(i), 1170.12, subds. (a)-(d).) His earlier Marsden motion (People v. Marsden) was denied. The trial court sentenced him to a total of eight years in state prison. He obtained a certificate of probable cause and filed a timely appeal from the judgment.[]
We appointed counsel to represent him on appeal.
After examination of the record, counsel filed an "Opening Brief" in which no issues were raised. On February 5, 2003, we advised appellant that he had 30 days within which to personally submit any contentions or issues that he wished us to consider.
No response has been received to date.
We have examined the entire record and are satisfied that appellants attorney has fully complied with the responsibilities of counsel and that no arguable issues exist. (Smith v. Robbins (2000) 528 U.S. 259, 277-284; People v. Wende (1979) 25 Cal.3d 436, 441.)
The judgment is affirmed.
We concur: PERLUSS, P. J. ZELON, J. --------------- Notes: Appellant filed a petition for a writ of habeas corpus, In re Bobby A. Fields, case No. B164735, in conjunction with his appeal. The petition will be disposed of in a separate order.
