People v. Feuchtbaum

Appellate Division of the Supreme Court of New York, Second Department
Mar 1, 1932
235 App. Div. 746 (N.Y. App. Div. 1932)

Opinion

March, 1932.

Judgment of conviction of the Court of Special Sessions of the City of New York, Borough of Brooklyn, reversed on the law and the facts and a new trial ordered. The evidence before the court did not show that the defects in the brake and in the horn of the appellant's car showed culpable negligence which contributed to the bodily injury of the child Samuel Storchheim. Lazansky, P.J., Hagarty, Carswell, Scudder and Davis, JJ., concur.
