ORDER MODIFYING OPINION
[NO CHANGE IN JUDGMENT]
THE COURT:*
It is ordered that the opinion filed herein on November 6, 2012, be modified as follows:
1. On page 1 of the opinion, the second line, "Kathleen Blanchard, Judge" shall be replaced with "Kathleen Blanchard and Steven D. Ogden, Judges";
2. On page 2, first paragraph, line 5, "Accordingly, we will remand the matter for resentencing." shall be replaced with "Accordingly, we will remand the matter to the original sentencing judge for resentencing.";
3. New footnote [2], on page 2, at line 5 [the end of the first paragraph on that page]. The text of the new footnote is as follows: "Steven D. Ogden, was the original sentencing judge." This modification does not change the judgment. *EPSTEIN, P. J. MANELLA, J. WILLHITE, J.
