Motion to amend remittitur granted. Return of remittitur requested and, when returned, it will be amended by adding thereto the following: Upon the appeal herein there was presented and necessarily passed upon a question under the Fourteenth Amendment to the Constitution of the United States, viz.: Defendant contended that the use of perjured testimony and the suppression of evidence beneficial to him by the People resulted in his conviction and violated his right to due process of law guaranteed by said amendment. The Court of Appeals held that there was no violation of such right.
