People v. Fantum

Supreme Court, Appellate Term, Second Department
Aug 16, 1982
116 Misc. 2d 376 (N.Y. App. Term 1982)

Opinion

August 16, 1982

Appeal from the District Court, Nassau County, HAROLD FERTIG, J.

Matthew Muraskin, Michael J. Obus and Ronald Minkoff for appellant.

Denis Dillon, District Attorney ( Anthony J. Girese and Lawrence J. Schwarz of counsel), for respondent.

MEMORANDUM.

Judgment of conviction affirmed.

Defendant's guilt was established beyond a reasonable doubt. In addition, the People effectively communicated their readiness for trial on December 1, 1980 so as to meet the requirements of CPL 30.30. As to defendant's contentions concerning the prosecution's comments during summation and the court's charge, we find no reversible error.

FARLEY, P.J., SLIFKIN and WIDLITZ, JJ., concur.
