People v. Fales

Supreme Court of Colorado. En Banc
Mar 6, 1978
576 P.2d 160 (Colo. 1978)

Opinion

No. 27605 No. 27611

Decided March 6, 1978.

Appeal by the People from a ruling of the trial court which granted appellee's pre-trial motions to dismiss, holding the pimping statute (section 18-7-206, C.R.S. 1973) facially unconstitutional.

Reversed

Appeal from the District Court of El Paso County, Honorable Bernard R. Baker, Judge.

J. D. MacFarlane, Attorney General, David W. Robbins, Deputy, Edward G. Donovan, Solicitor General, Robert L. Russel, District Attorney, David H. Zook, Deputy, for plaintiff-appellant.

No appearance for defendant-appellee.

Two separate indictments brought by the El Paso County Grand Jury charged the appellee with pimping. The trial court granted the appellee's pre-trial motions to dismiss, holding the pimping statute facially unconstitutional. We reverse for the reasons stated in our opinion in People v. Stage, 195 Colo. 110, 575 P.2d 423, and remand the cause for further proceedings consistent with that opinion.

Section 18-7-206, C.R.S. 1973.

MR. JUSTICE LEE does not participate.
