DECISION & ORDER ON MOTION

Motion by the appellant pro se to enlarge the time to serve and file a supplemental brief on an appeal from a judgment of the Supreme Court, Kings County, rendered May 10, 2007, for a reconstruction hearing, for leave to file an oversized pro se supplemental brief, and to enlarge the judgment roll to include, inter alia, the motion papers filed in connection with the motions pursuant to CPL 330.30, and a certain photographic array.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to enlarge the time to serve and file the pro se supplemental brief is granted, the appellant's supplemental brief shall be served and filed on or before March 8, 2013, and the appellant shall file nine copies of the supplemental brief and serve one copy on the District Attorney; and it is further,

ORDERED that the branch of the motion which is to enlarge the judgment roll to include the motion papers filed in connection with the motions pursuant to CPL 330.30 and the photographic array entered into evidence at the suppression hearing as People's Exhibit One is denied as unnecessary as these documents are already a part of the judgment roll; and it is further,

ORDERED that on or before January 22, 2013, the respondent is directed to file with the Clerk of this Court the photographic array entered into evidence at the suppression hearing as People's Exhibit One; and it is further,

ORDERED that the branch of the motion which is for leave to file an oversized pro se supplemental brief is denied without prejudice to making an application to the Clerk of the Court for this relief upon proper papers (see 22 NYCRR 670.10.3[e]); and it is further,

ORDERED that the motion is otherwise denied.
