People v. Eugene

Appellate Division of the Supreme Court of New York, First Department
Nov 7, 1949
276 App. Div. 751 (N.Y. App. Div. 1949)

Opinion

November 7, 1949.

Present — Peck, P.J., Glennon, Dore, Cohn and Van Voorhis, JJ.

On the first count the District Attorney, on argument, conceded that there was lack of corroboration of the police officer's testimony and that the first count should be dismissed. Corroboration on the second count is questionable and we think the offense charged was not established beyond a reasonable doubt. Judgment unanimously reversed and the information dismissed.
